2. PURPOSE

These General Terms and Conditions of Sale (hereinafter “G.C.S”), define the terms and conditions under which any person (hereinafter “the Customer”) orders and purchases the products sold by the company La Tarte Tropézienne (hereinafter “ La Tarte Tropézienne”), as part of a distance selling system on the Internet, for goods defined in the sales catalog of the websites www.latartetropezienne.com (hereinafter “The Site”)

3. APPLICATION OF THE GENERAL CONDITIONS OF SALE

3.1. These G.C.S are brought to the attention of the Customer to enable him to place an order.

3.2. The fact that the Customer completes an order on the Site and confirms the order implies full and complete acceptance of these T&Cs, which alone will be applicable to the following contract.

3.3. La Tarte Tropézienne reserves the right to modify in whole or in part and at any time these T&Cs.

4. CHARACTERISTICS OF THE GOODS OFFERED

4.1. The products offered to the Customer are those listed in the catalog published on the Site within the limits of available stocks and subject to the proper functioning of the Site.

4.2. Each product is presented with a photograph and a description established by La Tarte Tropézienne. The descriptions are intended to present to the Customer the essential characteristics of the products before the final order is taken.

5. ORDER AND CONFIRMATION

5.1. Taking an order on the site involves opening a Customer Account by entering two identifiers: an e-mail address and a password. These identifiers are and must be kept confidential. The right of access by the Customer to the identifiers can be made on simple request to the Internet Customer Service of La Tarte Tropézienne, which will only respond by e-mail to the address used when creating the Customer Account.


5.2. To place an order, the Customer undertakes to fill in the elements of his order with precision and rigor. As such, he undertakes to fully inform the various sections necessary for the proper processing of his order:
•Choice of product(s)
•Choice of billing address
•Choice of delivery address (for home delivery)
•Choice of delivery date

•Choice of payment method

•Verification and validation of the order and the General Conditions of Sale

•Payment of the order under the conditions provided.

5.3. La Tarte Tropézienne will confirm the order and its payment:
•On the Site, following payment
• By e-mail, to the e-mail address indicated by the Customer.

5.4 Modifying an Internet order For any order modification (billing address, delivery address, delivery date or content of the order), the Customer must contact the Internet Customer Service no later than 2 working days before the delivery date. . By e-mail: ecommerce@latartetropezienne.fr or by telephone: 04 94 43 41 20. In the event of modification or cancellation of the order or the delivery conditions, a credit note for the corresponding amount will be sent by e-mail to the Customer. No refund can take place. The Internet Customer Service can be reached from Monday to Friday from 10 a.m. to 12 p.m. and from 2 p.m. to 4 p.m.

5.5. La Tarte Tropézienne reserves the right to refuse an order if the customer fails to fulfill one of its obligations, and more generally, to refuse any order that is abnormal or incomplete for any reason whatsoever. The order is only final after confirmation by La Tarte Tropézienne. La Tarte Tropézienne will confirm to the customer the acceptance of his order by email or, if necessary, his refusal within 48 working hours following the entry of his order on the Internet.

5.6: ATTENTION: Some departments are delivered within 48 hours. This is beyond the control of La Tarte Tropézienne and Chronofresh does everything to deliver these departments within 24 hours as quickly as possible. Find the postal codes concerned by clicking here.

ATTENTION: For important events such as weddings, birthdays, baptisms... We recommend delivery THE DAY BEFORE so that redelivery (Tuesday to Saturday) is possible in the event of any delay.

In the event of late delivery, the delivery costs will be refunded to you (after agreement with Chronofresh).

In the event of a delay of more than 24 hours, a full refund should be granted after agreement with Chronofresh.

6. MEANS OF PAYMENT

6.1. Payment for products is made by VISA, MASTERCARD, AMERICAN EXPRESS or PAYPAL credit card, online from, through the secure payment system of the La Tarte Tropézienne banking establishment. Validation of payment by credit card is immediate.
6.2. To be registered, the order must be paid in full. Unpaid orders cannot be processed.

7. PROOF

7.1. La Tarte Tropézienne, via its host QUAI 13, stores purchase orders and invoices in its computer system and under reasonable security conditions.
7.2. Consequently, the computerized registers of QUAI 13 constitute a reliable and durable medium that can be produced as evidence.

8. RIGHT OF WITHDRAWAL

8.1. The 14-day withdrawal period does not apply to contracts for the supply of perishable or agri-food products, such as the goods sold by La Tarte Tropézienne. Also, the Customer cannot rely on it.

8.2. For other Products (dry and pre-packaged), in accordance with Article L.221-18 of the Consumer Code, the Customer has a period of fourteen days from receipt of the Product to exercise his right to withdrawal from the Seller, without having to justify reasons or to pay a penalty, for the purpose of exchange or reimbursement, provided that the Products are returned in their original packaging and in perfect condition of presentation and conservation, in 14 days following notification to the Seller of the Customer's decision to withdraw.

Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be put back on the market in new condition, accompanied by the purchase invoice.
Damaged, soiled or incomplete Products are not taken back.

In the event of exercise of the right of withdrawal within the aforementioned period, only the price of the Product(s) purchased and the delivery costs are reimbursed; the return costs remain the responsibility of the Customer. The exchange (subject to availability) or refund will be made within 14 days of receipt by the Seller of the Products returned by the Customer under the conditions provided for in this article.

For refund requests due to delivery delays, La Tarte Tropézienne must first obtain a refund from Chronofresh, which is the official carrier, before being able to subsequently reimburse the customer.

La Tarte Tropézienne strongly recommends delivery THE DAY BEFORE important events in order to anticipate an exceptional delay in Chronofresh delivery.

Customer complaints must also be made to Chronofresh directly on 0 825 950 11 with your tracking number in the form XY123456789VF.

9. CONSUMER MEDIATION

9.1. In the event of a dispute, the E-commerce Customer must first contact the customer service department of La Tarte Tropézienne. For this, the customer-consumer can reach the "customer service" or the management by email at the address: ecommerce@latartetropezienne.fr or at the following postal address: La Tarte Tropézienne. The company undertakes as a result of this complaint to provide its response / solution within a maximum period of 4 weeks.

9.2. If the E-commerce Customer considers that he has not received a satisfactory response to his complaint (or non-response) from customer service beyond 2 months, he may contact C&C-mediation, entity designated as "lead mediator".

In the event of an unresolved dispute, the consumer mediator can be contacted at the following addresses:

10. OUT OF STOCKS

10.1. The products sold on the site are available for sale.

10.2. A product that has become unavailable will be immediately removed from the catalog and any order will be impossible to place.
